FilingOak Electronic Communications & E-Sign Consent

FilingOak is operated by Enterobiz LLC, a New Mexico limited liability company. “FilingOak,” “we,” “us,” and “our” refer to Enterobiz LLC doing business through the FilingOak brand.
1. Scope
This Consent applies to electronic records, communications, and signatures used through FilingOak, FounderVault, and supported FilingOak workflows.
2. Consent to Electronic Records
By affirmatively accepting this Consent or proceeding through a transaction after it is presented, you consent to receive supported agreements, disclosures, notices, filing documents, signature requests, billing and renewal notices, and other service records electronically to the extent permitted by law.
3. Electronic Signatures
An electronic signature or electronic act you intentionally apply through a supported FilingOak workflow may have the same legal effect as a handwritten signature to the extent recognized by applicable law. FilingOak may provide built-in electronic signatures and, where supported, a download-sign-reupload alternative. Some agencies or circumstances may require another signature method.
4. Intent and Authority
You may sign only for yourself or a person or entity you are authorized to represent. Using a signature control represents your intent to sign the associated record. Forgery or unauthorized use of another person's signature is prohibited.
5. Hardware and Software
You need internet access, a supported browser or interface, the ability to view common electronic document formats such as PDF, and a supported communication channel. To retain records, you need the ability to save, download, or print them.
6. Alternative Signature
Where supported, you may download a document, sign it separately, and upload it back to FilingOak. Availability depends on the document, agency, jurisdiction, and workflow.
7. Contact Information
Keep supported contact information current so FilingOak can deliver electronic records and operational communications.
8. Withdrawal
Where applicable law gives you a right to withdraw electronic consent, you may use FilingOak's designated method. Withdrawal is prospective and does not invalidate previously completed electronic signatures or records. It may affect FilingOak's ability to provide a service electronically; FilingOak will explain available alternatives where applicable.
9. Copies
You should save records you wish to retain. FilingOak may also make records available in FounderVault while retained. Paper copies, if available, may carry a reasonable disclosed cost where permitted by law.
10. Government Requirements
Electronic consent does not override lawful government or third-party requirements for a specific signature, original document, notarization, identity verification, or delivery method.
11. Operational Communications
Filing updates, signature requests, document notices, security messages, compliance reminders, renewal notices, billing notices, and support communications may be necessary to administer requested services. They are distinct from promotional marketing.
12. Non-Waivable Rights
Nothing in this Consent waives rights or requirements that applicable law does not permit the parties to waive.
