WHY THE PROCESS IS DIFFERENT
Your LLC may be formed. The online EIN application may still be unavailable.
Forming a U.S. LLC and obtaining an EIN are separate processes. The state creates your LLC. The IRS assigns its Employer Identification Number.
For many U.S. residents, the EIN application can be completed through the IRS website using the responsible party’s SSN or ITIN. A non-U.S. resident without either number cannot use that ordinary online route.
That does not prevent the LLC from obtaining an EIN. It means the application must follow a different process using Form SS-4.
The form is only one part of the application.
The LLC name must match its formation record. The real responsible party must be identified. The entity structure and business activity must be described accurately. The application must also include the authorization required for FilingOak to receive the newly assigned EIN and answer IRS questions about completion of the form.
A small inconsistency may not look important while the form is being completed. It becomes more important when the IRS has to decide whether the application contains everything required to assign the EIN.

You receive the EIN
If the IRS releases the newly assigned EIN to FilingOak while our limited authority remains active, we send it securely to you.
PROCESSING TIME
The current estimate is 3–4 weeks. The IRS controls the timeline.
The estimate begins after FilingOak has received all required information, completed its review, and submitted Form SS-4. It does not begin when an incomplete order is placed.
There is no FilingOak rush package.
FilingOak does not sell an expedited tier or charge an additional fee for a faster promise. After submission, FilingOak follows the applicable processing period before making a status inquiry.
Adding the word “express” to a checkout option would not make the IRS move faster. It would only make the checkout more expensive.

Your signature is supplied by you. Its use is limited by your authorization.
FilingOak does not create, imitate, or sign your name for you. You draw and provide your signature through the secure order form after reviewing the authorization and accuracy acknowledgements.
The authorization allows FilingOak to reproduce and place that supplied signature on the Form SS-4 prepared for your LLC. It may be used only for the EIN application connected to your order.

Where the authority stops
FilingOak cannot become your responsible party, control your LLC, sign unrelated documents, receive general IRS mail, obtain Letter 147C as an SS-4 designee, or represent you in future IRS matters.
The Third-Party Designee authority ends when the EIN is assigned and released or after it posts to the IRS Master File. It does not create continuing authority over your LLC or tax records.
HOW YOU RECEIVE YOUR EIN
FilingOak may receive the EIN. The IRS mails the original confirmation to you.
Return fax or status inquiry
If the IRS returns the newly assigned EIN to FilingOak by fax, or releases it during an authorized status inquiry while our authority remains active, FilingOak sends it securely to you.
CP 575 goes to your address
The IRS mails the original CP 575 notice to the mailing address entered on Form SS-4. You provide that address. FilingOak does not substitute its address for yours.
Letter 147C is not included
An SS-4 Third-Party Designee cannot receive Letter 147C. If it is later needed, the responsible party must request it directly or appoint a separately authorized eligible representative.
If FilingOak does not receive the return fax
The absence of a return fax does not necessarily mean the EIN was not assigned. FilingOak may make a status inquiry after the processing period. If the EIN has already posted to the IRS Master File, FilingOak’s authority may have ended before the number was received. In that situation, the customer must receive the written confirmation sent to the address of record.

Can a non-U.S. resident obtain an EIN without an SSN or ITIN?+
Yes. An eligible non-U.S. resident may obtain an EIN for a U.S. LLC without an SSN or ITIN by following the Form SS-4 process rather than the ordinary online application.
Must my LLC already be formed?+

Is the EIN itself free?+

Does FilingOak stop after submitting the first fax?+
No. FilingOak allows the applicable processing period to pass and then makes a status inquiry when appropriate. If no EIN was assigned and the IRS requires correction or resubmission, FilingOak continues handling the application within its authority.
Where will the IRS send CP 575?+
The IRS mails the original CP 575 notice to the mailing address entered on Form SS-4. You provide that address during the order process. FilingOak does not substitute its own address for yours.
Can FilingOak obtain Letter 147C for me?+
No. The authority granted through the Third-Party Designee section of Form SS-4 does not authorize FilingOak to receive Letter 147C. The responsible party must request it directly or use a separately authorized eligible representative.
What does my signature authorize?+
It authorizes FilingOak to prepare and submit the specific Form SS-4 connected to your order, receive the newly assigned EIN, and answer IRS questions about completing that application. It does not authorize unrelated filings or general representation.
